The theory

The at-fault vehicle was owned or operated by a governmental entity. The recovery exists but is governed by the state's tort claims act: notice of claim within a short window, damages caps, and immunity for some functions.

  • Theory chunk exists and is held at approved, not active, until governmental notice obligations are curated for every state.

  • Immunity for the function involved.
  • Missed notice-of-claim deadline (typically 60–180 days).

  • Governmental claim form within the statutory window: before any demand or suit.

  • File the notice of claim first, within the statutory window; the demand follows.
